Privacy Statement Regarding Customer and Online User Information

This Privacy Policy governs the manner in which DriveSavers, Inc. collects, uses, maintains, and discloses information collected from users (each, a “User”) of the DriveSavers data recovery website (“Site”). This privacy policy applies to the Site and all products and services offered by DriveSavers, Inc. This Privacy Statement does not apply to the websites of our reseller service providers or to any other third parties, even if their websites are linked to our website. DriveSavers complies with the EU-U.S. Data Privacy Framework and the Swiss-U.S. Data Privacy Framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of personal information transferred from the European Union and Switzerland to the United States, respectively. DriveSavers has certified to the Department of Commerce that it adheres to the Data Privacy Framework Principles. If there is any conflict between the terms in this privacy policy and the Data Privacy Framework Principles, the Data Privacy Framework Principles shall govern. In compliance with the U.S.-EU and Swiss-U.S. Data Privacy Framework Principles, DriveSavers commits to resolve complaints about your privacy and our collection or use of your personal information. European Union or Swiss individuals with inquiries or complaints regarding this privacy policy should first contact DriveSavers at: [email protected].

DriveSavers has further committed to refer unresolved privacy complaints under the Data Privacy Framework Principles to an independent dispute resolution mechanism, the BBB EU DATA PRIVACY FRAMEWORK, operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit https://bbbprograms.org/programs/all-programs/dpf-consumers/ProcessForConsumers for more information and to file a complaint. In limited circumstances, claims not resolved through other channels may be eligible for binding arbitration before a Data Privacy Framework Panel. DriveSavers is subject to the investigatory and enforcement jurisdiction of the Federal Trade Commission.

Personal Identification Information

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, place an order, subscribe to the newsletter, fill out a form, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, and phone number. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personal identification information, except that it may prevent them from engaging in certain Site related activities.

Non-Personal Identification Information

We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer, and technical information about Users’ means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

DriveSavers, Inc. may collect and use Users’ personal information for the following purposes:

  • To improve customer service: We may use information provided by users to help us respond to customer service requests and support needs more efficiently.
  • To personalize user experience: We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site.

Disclosing Personal Information

We do not sell, trade, or rent Users’ personal identification information to others. We will provide notice and opt-out choice if ever DriveSavers does share such information with non-agent third parties. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our reseller service providers, trusted affiliates, and advertisers for the purposes outlined above. We may use third-party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes. We are potentially liable in the case of onward transfers to third-party service providers.

We may disclose your Personal Information in connection with law enforcement, fraud prevention or other legal action; as required by law or regulation; or if DriveSavers reasonably believes it is necessary to protect DriveSavers, its customers, or the public. DriveSavers may be required to provide personal information in response to a lawful request from governmental authorities, including to meet national security or law enforcement requirements.

How To Access And Control Your Personal Data

You have choices about how to manage your personal data and what types of communications you receive from us. If you contact us, we will endeavor to respond to your inquiry within 30 days. Please note that we may have a legal obligation to preserve certain data.

How We Protect Your Information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information, and data stored on our Site.

Sensitive and private data exchange between the Site and its Users happens over an SSL secured communication channel and is encrypted and protected with digital signatures. Our Site is also in compliance with PCI vulnerability standards in order to create as secure of an environment as possible for Users.

The retention period for data we process can vary based on certain circumstances or obligations. For example, we retain personal data for as long as it is necessary to provide the products or services you have requested, or for other legal compliance or essential business purposes such enforcing our contracts, maintaining the security of our products, or dispute resolution.

Children’s Online Privacy

Our website is a general audience site and is not intended for use by children under 18. DriveSavers, Inc. has the discretion to update this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.
